Terms of Service

1. Our Mission

Visible was built to help Visibility Builders™ create more visibility, build trust, generate momentum, and create new opportunities. These Terms exist to create a safe, transparent, and trusted experience for everyone using the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Platform. By creating an account, you represent that all information you provide is accurate and complete.

3. Your Account

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity occurring under your account.
• Keeping your information accurate and up to date.
• Promptly notifying us of any unauthorized access.

You may not share your account in violation of your subscription plan.

4. Subscription Plans

Visible is provided as a recurring subscription service. Subscription plans, features, usage limits, and pricing are described on our Pricing page and may change from time to time. Your subscription begins when payment is successfully processed.

5. Billing & Payments

Subscriptions renew automatically each billing period until cancelled. By subscribing, you authorize us (or our payment processor) to charge your selected payment method for recurring subscription fees.

You are responsible for:

• applicable taxes
• maintaining valid payment information
• timely payment of all subscription fees

If payment cannot be processed, we may suspend or terminate access until payment is received.

6. Upgrades, Downgrades & Cancellation

You may upgrade or downgrade your subscription at any time through your account settings. Changes may take effect immediately or at the beginning of your next billing cycle depending on your selected plan.

You may cancel your subscription at any time. Cancellation prevents future renewal charges but does not automatically generate refunds for fees already paid unless required by applicable law or expressly stated in our Refund Policy.

7. Visibility Engines™

Visible includes AI-powered Visibility Engines™ that help Visibility Builders create, organize, enhance, publish, and distribute content and visibility strategies. Current and future Visibility Engines may include, but are not limited to:

• Swarm™
• Reach™
• Ascend™
• Amplify™
• Orbit™

We may introduce, modify, improve, replace, or discontinue features or Visibility Engines as the Platform evolves.

8. AI Assistance

Visible uses artificial intelligence to assist users in creating content, recommendations, workflows, and other outputs. AI-generated content should always be reviewed before publication or distribution.

You remain solely responsible for:

• reviewing outputs
• verifying factual accuracy
• ensuring legal compliance
• approving all published content

AI may occasionally produce inaccurate or incomplete information.

9. Customer Content

You retain ownership of the content you create, upload, or submit through the Platform. By using Visible, you grant Intensifi AI a limited, non-exclusive license to process, store, display, and transmit your content solely as necessary to provide the Platform and its services. We do not claim ownership of your original content.

10. Acceptable Use

You agree not to use Visible to:

• violate applicable laws or regulations
• infringe intellectual property rights
• distribute malware or malicious code
• engage in fraud or deceptive practices
• generate or distribute unlawful content
• impersonate others
• interfere with Platform security or operation
• abuse or exploit AI-generated functionality

11. Third-Party Services

Visible may integrate with third-party platforms, including social media services and other online tools. Your use of those services remains subject to their own terms and privacy policies. Intensifi AI is not responsible for changes, outages, restrictions, or actions taken by third-party providers.

12. Intellectual Property

Visible™, the Visibility Platform™, Visibility Engines™, software, logos, trademarks, graphics, documentation, and related intellectual property remain the exclusive property of Intensifi AI or its licensors. These Terms do not transfer ownership of any intellectual property to you.

13. Platform Availability

We strive to provide reliable service but cannot guarantee uninterrupted or error-free operation. From time to time we may perform maintenance, upgrades, or modifications that temporarily affect availability.

14. Beta Features

Certain features or Visibility Engines may be identified as Beta, Preview, Early Access, or Experimental. These features are provided "as is" and may change or be discontinued without notice.

15. Disclaimer of Warranties

Visible is provided on an "as available" and "as is" basis. To the fullest extent permitted by law, Intensifi AI disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific business results, rankings, visibility levels, sales, revenue, or other commercial outcomes.

16. Limitation of Liability

To the maximum extent permitted by law, Intensifi AI shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us during the twelve (12) months preceding the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless Intensifi AI, its officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, and expenses arising from:

• your use of the Platform
• your content
• your violation of these Terms
• your violation of applicable law

18. Suspension & Termination

We may suspend or terminate accounts that:

• violate these Terms
• violate applicable law
• threaten Platform security
• abuse Platform resources
• engage in fraudulent or harmful activity

Termination does not relieve you of outstanding payment obligations.

19. Changes To These Terms

We may update these Terms from time to time. When material changes are made, we will update the Effective Date and provide notice where required by applicable law. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

20. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes shall be resolved in the appropriate courts located within that jurisdiction unless otherwise required by applicable law.
